| 摘 要： | 法治理念下我国侦查目的应由终极目的、深层目的、表层目的三个层次构成。要克服我国现行侦查目的实现方式的缺陷,加强侦查程序公开制度建设,科学规定侦查阶段辩护人享有的诉讼权利,增强侦查程序的中立性,强化侦查机关的客观公正义务,确立侦查中的司法审查机制,建立科学的羁押制度,赋予犯罪嫌疑人在讯问中有沉默的权利,确立科学规范的权利告知程序。

| Abstract: | The investigation aim,in the shed of constitution,consists of three levels: ultimate aim,intermediate aim and present aim.Some measures should be taken to overcome the disfigurements in realizing the investigation goal,such as enhancement of publicity system for investigation procedure,scientific regulations for defendant's rights at investigative period,improvement of neutrality of investigative procedure,aggrandizement of justness of investigative organization,establishment of judicature checking mechanism,setting up scientific detainment system,entrustment of right to silence to the suspect at the period of inquest and establishment of scientific and normative informative system. |
