| 摘 要： | 民众对刑事立法、刑事司法、刑事法治环境尤其是典型刑事司法案件等现实层面的感受往往通过刑法情绪释放出来。民众刑法情绪是衡量刑法认同和刑法信仰程度的重要心理暗示。受"杀人偿命"等传统刑法观、现代仇恨犯罪理念、刑罚效果不彰和刑事司法系统运作不力等因素影响,民众刑法情绪会流露出恶性倾向,但亦有培养民众良性刑法情绪的现实土壤。民众良性刑法情绪的养成则助益于刑事政策贯彻、刑事司法运行、刑法社会效力的彰显、理性刑罚观和犯罪论的培养和刑法情怀的塑造。

| Abstract: | People tend to express their feelings for criminal legislation,justice and the entire legal environment,especially typical criminal judicial cases through criminal mood.Public criminal mood measures criminal recognition and belief degree.Affected by traditional idea of revenge,abhorrence to crime in modern times,ineffective punishment and inadequate justice operation,people show malignant moods towards criminal law.Public favorable criminal mood helps to carry out criminal policy,implement criminal justice,show social effect of criminal law,foster rational criminal view and criminology and shape criminal affection. |
