| 摘 要： | 凉山彝族“德古”调解制度已有数千年的历史,至今在彝族人的法律生活中还发挥着重要作用。本文根据作者田野工作获得的案例进行了分析,展示出“德古”在解纷中对规范运用的充满人性的真实过程,德古们高超地融情、理、法于一体的法律艺术,出色地维护了彝区的社会秩序,不仅表明德古制度的重要功能,同时也揭示出彝族人的法律智慧及其创造性的精神价值,这对于当代司法制度改革富有极大的启示。

| Abstract: | Degu Conciliation System of Yizu in Liangshan Atonomous Prefecture,Sichuan Province,with a history of thousands years,has also play an important role in Yizu's legal life.This dissertation,based on cases of field work,shows Degu's reasoning in the phase of disputes resolution,as well as their superb legal skills,which make feelings,reasonings and laws in perfect harmony.Today's judicial reform should draw inspiration form Degu Conciliation System,which gives key play to social order in Yizu inhabitant areas and also shows legal wisdom and creativity of Yizu people. |
