论贵州民族民间文化资源法律保护在产业优势转化中的功能

近年来,素有"文化千岛"美誉的贵州省,正面临着如何将民族民间文化之资源优势转化为产业优势的历史难题。因此,通过全面分析民族民间文化的特殊性及现行法律对该类文化保护中存在问题,进而进行有关民族民间文化资源法律保护,特别是知识产权制度安排的理论探讨,争取为贵州民族民间文化资源的整套法律保障体系的尽快建立建言献策,成为本文戮力而为的重要内容。

On the Functions of Legal Protection of Guizhou Ethnical Folk Cultures in the Procedure of Industria Predominance Transformation

Guizhou Province,which is prestigious as the "Cultural Isles",is facing the difficult problem of transforming its predominance in ethnical folk cultural resources to be an industrial one.Basing on the all-around analysis of the specialities of the ethnical folk cultures and on the existing problems about the protection of present laws to these cultures,this paper puts forward such proposals: On one hand,the present laws,especially those of intellectual property rights,should be employed to realize the protection to the ethnical cultural resources in Guizhou Province,On the other hand,a special protection system for the ethnical folk culture should be established in the near future.
