网络商业秘密的刑法保护

随着互联网的发展，商业秘密侵权行为的严重性和行为的恶劣性已经不是民事法律、行政法律所能解决的了．网络商业秘密在需由民法、行政法、经济法调整的同时，将日益需要刑法的调整。在网络环境下，侵犯商业秘密犯罪的犯罪客观方面，犯罪主观方面、犯罪主体均产生了很大的变化．现行刑事立法的规制已明显不足，建议尽快修定相关法律法规或对现有规范进行有权解释、加大对网络商业秘密的刑法保护力度。

The author suggest that we should castigate the correlative law or statute as early as possible, so as to increase the extent of the criminal protection of network commercial secret.
