新出入境管理法研析

新出入境管理法进一步了适应我国对外国人管理的新形势,实现了"统一立法"、建立"管理与服务并重"新理念,将科学技术手段纳入新管理系统,在确保我国的国家安全和社会稳定的前提下,为我国居民与来华外国人提供更多便利。在关注新出入境管理法具有的重要意义之余,本文将深入分析新法存在职能重叠、处罚范围不确定、国际合作不到位、执法严重滞后于立法、外国人权益保护规定缺乏的问题,进一步提出相关建议,以期法律的进一步完善。

Analysis on China＇s New Exit-Entry Administration Law

China＇s new Exit-Entry Administration Law adapts to the new situation better by realizing ＂unified legislation＂, establishing the new concept of ＂paying attention to administration and service＂, and applying science and technology to the management system in order to provide more convenience for our citizens and foreigners with the premise of national security and social stability. Concerned about the significance of the new law, this paper also undertakes an in-depth analysis of the problems of the new law, such as overlapping functions, uncertainty of punishment range, lack of international cooperation, a lag between legislation and law enforcement, lack of regulations to protect foreigners＇ rights and interests, and makes some further recommendations to realize a further refinement of the law.
