有组织犯罪中的证人特点及其保护对策

在打击有组织犯罪中,证人不敢作证或不愿意作证是一个令执法机构最为棘手的问题。究其原因,在于我国缺乏有效的证人保护机制。文章归纳这一类证人区别于其他刑事犯罪证人的一些特点,针对这些特点提出一些保护这类证人的措施:制定专门的证人保护法案;设立“证人豁免”措施;专门机构对证人提供保护;使用实时网线作证;扩大证人保护范围;尊重拒绝作证的权利。

The Characteristics of Witnesses and Protective Countermeasures in Organized Crime

In combating organized crime,witnesses are afraid of or not willing of testimony.It is a very stubborn problem to legal machineries. What is the reason? Our state is lack of effective protecting-net for witnesses.This article generalizes some characteristics of the witnesses who are different from other criminal witnesses,and puts forward some proposals to protect the witnesses:to make specialized witness protection law;to establish"witness immunity" measure;specialized organization should offer protection to witness;to testify by using network;to expand the range of witness protection;to respect the right of refusing testimony.
