行政拘留若干问题探讨

行政拘留是针对违法行为人最严厉的一种行政处罚,是在一定时限内对人身自由的剥夺,适用于严重违反行政管理但不构成犯罪,而警告、罚款处罚不足以惩戒的情况。因此相关法律对行政拘留的适用作出了严格规定。但是基层民警在适用该项法律制度时还存在误区,因此文章就行政拘留的法律文书、投所执行、暂缓执行、执行豁免等实务问题进行了阐释。

A Discussion on Some Problems in Administrative Detention

Administrative detention is the most severe punishment aimed at violations,and is the deprivation of freedom within a certain time limit,also is applied to a serious violation of administrative management which does not constitute a crime,but it is not enough to be punished by warning or fine punishment.So it is necessary to make strict regulations on administrative detention application in related laws.But there still exists some misunderstandings.Therefore,this paper aims to expatiate some practice on the application of the law system issues such as the legal documents of administrative detention,sending to labor camp execution,the suspension of the execution and executive immunity
