| 摘 要： | 鉴定结论是诉讼的法定证据之一，但鉴定结论只是一种证据形式，它不具有“天然”的证据能力，也不等同于科学结论、“最终结论”，它的证据能力的具备、证明力的发挥，需要一定的前提和条件。对鉴定结论的价值应从认识论、价值论、法学等多纬度去认识。

| Abstract: | The appraisal conclusion is one of the lawsuit legal evidence.But the appraisal conclusion is only one kind of evidence form.It does not have evidence ability naturally and it is not the final conclusion.It needs certain premise and the condition for bringing its ability of evidence into play.The appraisal conclusion's value should be understood from epistemology,the theory of value,the legal science and so on. |
