| 摘 要： | 汽车道路交通事故是现实生活中一种常见的侵权行为,构成道路交通事故侵权必须具备以下几个要件:道路交通事故必须是因车辆造成的事故;道路交通事故必须是发生在特定道路上的事故;有侵权行为;当事人的主观心理状态是过错或意外;道路交通事故必须要有损害后果;因果关系。以上是构成道路交通事故的必备条件,缺少其中任何一个要件,则不属于道路交通事故。
