论检警配合谈判主体模式的构建

谈判是处置劫持人质事件的重要手段和组成部分。与一般刑事案件不同，检察机关介入劫持人质案件处置、促进和平解决是其有别于一般刑事案件的本质所在。检警配合谈判主体是一种以配合为主与充分调动各方有机协调的谈判主体模式、是实现这一目标的根本保障。结合我国劫持人质犯罪的特点与司法实践的现状，应将检警配合谈判主体模式作为人质危机谈判中的一项可选择性机制。
