公安行政执法存在的问题及对策

目前公安行政执法中存在多方面问题,集中体现在公安行政执法人员有法不依;对公安行政执法程序认识不够,一些行为缺乏程序的约束,一些行为违反法律明确规定的程序,执法人员缺乏程序观念。就具体的公安行政执法内容来说,劳动教养已与现行法律相抵触,其他某些涉及人身的强制措施存在合理性也值得怀疑。要解决上述问题,除对公安行政执法诸环节予以完善外,加强对公安行政执法活动的监督亦至为必要。
