刑讯逼供的可治理牲探究

尽管国家法律法规一再明令禁止，但直至现代法制已形成与发展的今日，刑讯逼供现象仍然屡禁不止。各地公安机关都在为清除这一公害作出了不懈努力，在一定范围内取得了良好的效果。那么，在我国能从根本上治理刑讯逼供吗？无论是从理性主义、人道主义、正当程序主义等哲学基础方面进行的分析，还是于现实的人文基础、经济基础、法治环境基础和社会发展基础进行的分析，都能够得出刑讯逼供可治理的结论。但是刑讯逼供的治理也绝不是一蹴而就的，刑讯逼供的治理一定是一个渐进的过程。

So, in our country, can we govern the extoting confessions by torture fundamentally？ Whether to analyze from the rational, humanitarian, due process, and other aspects of the philosophical foundation, or based on the reality of the humanities foundation, economic foundation, the rule of law - based environment and social development, can we come to the conclusion that extorting confessions by torture may be governed.
