| 摘 要： | 文章针对刑事被害人国家补偿的立法空白,分析了建立国家补偿制度的必要性。当刑事被害人不能从罪犯那里获得实际赔偿时,国家补偿便成为一种重要的救济途径。文章进而探讨了建立国家补偿制度的理论依据,并提出了建立我国刑事被害人国家补偿制度的具体构想。

| Abstract: | According to the legislation empty of criminalvictims compensation,this article analyzes the necessity of national compensation system.When the criminal victims can get compensation from the actual criminals,the state compensation will become an important relief system.The paper further discusses establishing national compensation system,and puts forward the theoretical basis for the establishment of China＇s criminal compensation system. |
