| 摘 要： | 本文在分析了数罪并罚原则和异种主刑并罚的各种主张和学说的基础上,根据异种刑罚的不同作用,以及配刑和行刑的刑法原理,吸收以往学说的合理内核,摈弃不够合理的成分,认为应采用一种新的混合原则,即限制加重性并科,该原则能较好地把量刑的公正性要求和行刑的人道主义要求结合起来,在功利和报应中寻求平衡,最后论述了该原则对于罪犯的再社会化、重新回归社会乃至构建和谐社会的积极现实意义。
