| 摘 要： | 作为具有"东方经验"美誉的调解制度,在当下存在"迷航"的倾向,究其原因在于偏离调解的本义。而归正调解的航向,需要合乎三个基本维度,即合乎法律之维、合乎契约之维、合乎人性之维。破除调解当前迷思的固本之策在于调审分离,使调解回归调解本义——建立非诉讼化的调解制度,同时使审判回归审判本色,发挥调解、审判各自其本来的优势。

| Abstract: | As the mediation system with the reputation of “Oriental Experience”, its tendency of “getting lost” is due to deviating from the original meaning of mediation while it needs to conform to three basic dimensions, that is, the dimensions of laws, indentures and human natures, to correct the course of mediation. The basic strategies of getting rid of problems in mediation is to separate mediation from trial and make mediation back to its original meaning, which is to establish non-litigation mediation system and make trial return to basics in order to give full play to the original advantages of trial and mediation respectively. |
