| 摘 要： | 自首是我国重要的刑罚制度，在鼓励犯罪分子改过自新、节约司法资源、体现刑事政策等方面发挥着重要作用。但是由于案情各不相同，司法人员的法律水平不一，加上一些新的刑法理念的兴起，对自首的认定难免出现分歧。本文从司法实践中遇到的三起案例说起，从新角度谈自首的认定。

| Abstract: | Voluntary surrender is an important penalty system,which plays a key role in encouragement of criminals mending their way,saving judicial resources and embodying criminal policy.The cognizance of surrender has some diver-gences for the reasons that the differences of cases,the various level of the judicial personnels' law level and the appearance of new criminal law concept.The paper analyze the cognizance of surrender from new angle. |
