| 摘 要： | 公安行政检查攸关公民基本权益之保障,然而,公安行政检查无论在理论上还是在立法中,均未受到足够的重视。公安行政检查是一种独立的外部职权行政行为,应与公安行政调查和刑事搜查相区分。为贯彻法治主义和人权保障原则,公安行政检查应从设定权、法律保留、法律要件和程序等方面加以规制。

| Abstract: | Police administrative inspection is related with the guarantee people's basic rights and interests.However,it's lack of enough attention no matter in theory or in legislation.Police administrative inspection is an external administra-tive act of authority,which should be distinguished from police administrative investigation and criminal search.Police ad-ministrative inspection should be strictly regulated by law in permission,law restraint,law requirement and legal pro-cedure,so as to carry out the principles of constitutionalism and guarantee of human rights. |
