论我国量刑原则的实施及完善

量刑原则是指刑法规定的对于量刑活动具有指导意义和制约作用的法律准则。遵循合理科学的量刑原则，对于避免量刑偏差和实现刑罚目的都具有积极的作用。量刑的一般原则有依法量刑原则、罪责相当原则和量刑平衡性原则。我国司法实践中存在量刑原则不明确、随意性大、量刑不均衡等问题，需要进一步完善刑事立法、实行量刑建议制度及提高法官素质等。
