“侦查能力”初探

从学理上对"侦查能力"这一常用概念作出基本界定和深入探讨是必要的。"侦查能力"的涵义应从两个层面进行界定:宏观层面上的整体侦查能力、微观层面上的个体侦查能力。侦查能力由两个要素构成:主体要素、载体要素。侦查能力是特定主体通过一定载体体现出来的一种能力。侦查能力具有三个特征:综合性、实践性、专业性。根据不同标准,可以对侦查能力进行不同分类:整体侦查能力和个体侦查能力、侦查行为能力和侦查思维能力、现实侦查能力和潜在侦查能力。

It is necessary to research ＂investigation ability＂ deeply.The definition of ＂investigation ability＂ has two aspects： the whole investigation ability from the point of macroscopical aspect,the investigation ability of investigator from the point of microcosmic aspect.The investigation ability has two elements： subject and carrier.The investigation has three characteristics： complex,practice and professional.According to different criterions,the investigation ability can be divided into different sorts： the whole investigation ability and the personal investigation ability,the behavior ability of investigation and the thinking ability of investigation,the realistic investigation ability and the potential investigation ability.
