经济全球化与中国传统法文化的继承和创新

经济全球化已成为当今世界发展的大势。本文从经济全球化的定义和文化的特性研究入手,论述了经济全球化并不等于文化(包括法文化)的全球化,由于各民族、国家的特异性,势必会形成经济全球化背景下的法文化的多元化;同时,由于各民族、国家间的同一性,尤其是在经济全球化这个大背景下,又使各种不同的法文化的交流与相互吸收成为可能。在这种新的历史背景下,独具特色的中国传统法文化应坚持与时俱进,在体现本土性的同时,借鉴和移植域外法文化,实现中国传统法文化的创新。

On the economy globalization and the inheritance and innovation of the Chinese traditional culture

The economy globalization has been the trend of the world.The paper discusses on the unlikeness of economy globalization and culture globalization from the definition of the economy globalization and the characteristics of the culture,however,the law culture will be multiplied for the differences of nations on the background of the economy globalization.And the different law cultures will communicate and absorb each other because of the identity of the nations.In the new era,the characteristic Chinese traditional law culture should keep up with time and transplant the foreign law culture to realize the innovation of the Chinese traditional law culture.
