论合同相对性原则的突破

作为传统契约理论基础的合同相对性原则,已经不能够完全适应现代交易的发展。有鉴于此,各国(地区)立法和判例通过承认涉他合同,引入债权不可侵性理论,规定合同的保全制度,承认合同关系第三人之保护效力,以及租赁权的物权化,对合同相对性原则进行了修正和突破。
