| 摘 要： | 治安调解是公安机关依法对因民间纠纷违反治安管理行为的非处罚性解决纠纷的方式。在中国具有深远历史的调解文化的影响下,治安调解作为秉承传统调解制度精华和借鉴国外ADR方式基础上形成的办案方式,发挥着治安处罚所无法替代的作用。但在目前的实践中,公安机关对适用治安调解的案件范围、调解的效力等问题存在不同认识,因此应进一步研究其存在的问题并加以解决。

| Abstract: | Under the strong influence of the history of Chinese mediation,the public order mediation is developing rapidly.The public order mediation,influenced by traditional mediating culture and ADR,accords with social security of situation.But it existed some problems.We should rigidly restrict the applicable scope of public order mediation and validity of mediating contract. |
