| 摘 要： | 程序正义与实体正义，代表了刑事诉讼制度价值的双重性，同时也是侦查制度所要追求的最大目标。侦查公开作为刑事诉讼制度的一项重要内容，必然要在兼顾程序正义和实体正义之间寻找一个最佳平衡点。本文从侦查公开的法理基础、侦查公开的必要性角度出发，引进行政法的相关原则来探讨如何在刑事诉讼程序中寻求这样一个平衡点。
