试论完善我国宪法监督制度

我国的宪法监督制度存在着一些不足之处，主要表现在宪法监督的主体机构、法律制度不健全，因此，要完善我国宪法监督制度，应该建立专门的宪法监督机构，在人大之下设立宪法监督委员会，该机构拥有违宪审查权、宪法解释权、受理违宪诉讼权以及裁决国家机关的权限争议；完善宪法监督的法律制度，制定宪法修改法、宪法监督法、宪法解释法。此外，一个关键的问题是要提高全民的宪法意识。

On Improving the Supervision System of the Constitution of Our Country

There are some weak points in the system of supervision of the Constitution of our country, such as the incomplete central organ and lawful system of the Constitution supervision. So, in order to improve the system of the Constitution supervison, we should establish a special organ of the Constitution supervision That is a supervisory committee under People's Congress. This committee may have the power to investigate cases of voilating the Constitution, the power to explain the Constitution, the power to accept Constitution breaking lawsuit and the power to judge the disputes among government organs. It may also have the power to improve the lawful system of the Constution supervision, the power to draw up Revisionary Law of the Constitution, Supervisory Law of the Constitution and Explanatory Law of the Constitution. Besides, the most important problem is to improve the sense of the Constitution of the whole citizens.
