| 摘 要： | 国际反恐怖主义法是国际社会有关恐怖主义犯罪和处罚的规章、制度和原则、规则的总称。它是具有强制性的法律规范 ,而不是一种道德规范。国际反恐怖主义法本质上属于国际法范围的公法 ,它构成了惩罚恐怖犯罪的国际刑法的有关组成部分 ,因此同时兼具强行法和软性法的特性。它是由诸多法律制度、规章、规则和原则构成的。它的最主要任务是调整国家之间在预防和惩处恐怖主义中所结成的社会关系。所以 ,不能把世界各个国家的反恐怖国内法当作是国际反恐怖主义法

| Abstract: | International counter-terrorism law is a general state which expresses regulations,institutions and principles of international society against the crime of terror and punishment.As a compulsory rule of law,international counter-terrorism law is a vital part of international criminal laws,which nature is not considered to be national law but a kind of public international law instead.So it shares the characters of both the forced law and the soft law.The principal function of international counter-terrorism law is to adjust the relationship between nations for preventing and punishing terrorism. |
