概念是构筑一门学科的基本条件,研究刑事侦查学必须首先研究概念。现在的侦查学理论研究特别是基础理论研究基本处于各行其是之态,其重要原因是忽略了起点概念的重要作用。刑事侦查学的研究对象包括犯罪行为与侦查行为及二行为矛盾的规律、调整矛盾的对策。刑事侦查学属于刑事科学的子学科——非规范型刑事科学。学科体系分类为基础理论类、应用类、对策类。

Basic Train of Thought on Building up Criminal Investigative Discipline

Concept is a fundamental factor which is used to build up any discipline. The research situation of investigative basic theory in being is: each does what he thinks is right, each goes his own way, the important reason is to neglect the major function in the beginning concept. The research object of criminal investigative subject includes: offensive conduct, investigative activities, and the laws of contradiction between them, the countermeasures for adjusting this contradiction. As a subdivision of criminal jurisprudence, criminal investigative subject consists of fundamental theory, implied theory and countermeasure theory.
