宅基地退出的风险探析

宅基地对于保障农民住房及基础生存条件有着不可替代的作用,但现存的宅基地闲置、"一户多宅"等情况造成土地资源的浪费,故宅基地退出对实现土地资源的高效利用、深化农村土地制度改革具有重要意义。由于宅基地法律制度不完善、宅基地监管机制缺位、农村社会保障水平偏低等原因,致使宅基地退出面临着经济、社会、生态等方面的风险。应从完善立法、加强监管、强化农村社会保障等方面,全面规制宅基地退出的风险。

On the Risks Of Returning the Rural Homesteads

Rural homestead mechanism plays an irreplaceable role in safeguarding farmers ' housing and life conditions, but now in practice, it's a common fact that some rural homesteads are left unused or one family has more than one rural homestead, which leads to a big waste of the land resource, so, it's important to have the rural homesteads returned in order to make good use of land resource and promote the revolutions of rurul land mecha-nism. However, because of the imperfection of the laws, the absence of homestead supervision mechanism and the low levels of rural society security, various risks of returning rural homesteads cannot be avoided, such as economic risks, social risks and ecological risks. Therefore,if we can perfect the relevant legislation, strengthen the supervi-sion and improve the rural society security, the above risks will be believed to be regulated in all directions.
