| 摘 要： | 正义是社会制度的首要原则,实现制度正义是人类政治文明发展的基本目标。在现代社会,缺乏制衡的国家权力和资本权力往往成为威胁自由、民主与法治的压迫性力量。在中国政治发展的特定情势下,有效制衡国家权力与规训资本权力既是确保制度正义的关键,也是转型中国政治发展的关键议题。制度正义的实现,仰赖于一个高度组织化与制度化的现代社会的存在,并在一个开放的民主宪政制度框架中,通过各种政治行动者之间的平等博弈、公共协商和理性妥协而得以保障。

| Abstract: | Justice is the essential principle of social system and the fulfillment of system justice is the ultimate goal of human political culture development.In modern society,the state and capital power without balance could be the restrict strength that is harmful to freedom,democracy and law.The key to guarantee system justice and Chinese political development transformation is the balance of state and capital power in current situation.The fulfillment of system justice relys on a modern society that is highly organized and institutionalized,and on an open democratic and constitutional system to ensure through fair play,public deliberation and rational compromise among politicians. |
