中国旅行社业法律制度评述

文章首先理清了规制中国旅行社业的法律制度体系。其次 ,着重分析了各项具体法律制度在规制旅行社业方面的缺憾 ,同时也对旅行社业法律体系的总体缺憾作了概括性地分析。最后 ,针对这些宏观的 ,微观的缺憾提出了相应的解决办法 ,包括了制定《旅游法》;旅游合同典型化 ;发挥地方立法优势 ;加强国际交流等等。

Comments on Legal System of China's Traval Agency

In this article, first, it sorts out the legal system of specifying China's tourism. Second, it analyses flaws of individual legal in specifying traval agency and at the same time gives in brief outline an analysis of an overall flaw of legal system of trval agency. Last, this article puts forward a series of countermeasures on these macro and micro flaws including making "law of tourism",typifying tourist contracts, taking advantage of the strengths of local legislation and meanwhile promoting international communication.
