大学生村官职务犯罪的困境与防范——以王某贪污救济款为例

大学生村官政策是国家为解决大学生就业困难、农村人才匮乏而做的有益尝试。面对纷繁复杂的农村工作,一些大学生村官没能经受得起利益的诱惑,触犯了法律。虽然有相关政策法规的支撑,但由于其主体身份在法律定位的模糊性与客观履职行为的复杂性,使得司法实践中对于其职务犯罪在罪名认定、主体管辖等方面存在诸多争议,甚至出现了一些执法困惑,引发群众不满,影响了农村稳定和新农村建设。因此,对于此制度我们尝试从理论和实践中进行演进,以此探索出符合现实需要的路径,使得此政策得以可持续发展。

On Dilemma and Prevention of College Student Village Officials’ Duty Crime

The policy of college student village officials aims to make an attempt to solve the problem of the university students’ employment difficulty and the lack of talented persons in the countryside.Facing the complexity of the rural work,some student village officials could not stand up to the temptation of interests,and finally break the law.Although there are related laws and regulations,there still exists fuzziness in their legal positioning and complexity in working behavior,which leads to many disputes in the judicial practice,even influence the rural stability and new rural construction.Therefore,we try to take a probe into related theory and practice so as to explore a realistic path to make the policy have a sustainable development.
