法治思维视域下的个案办理--以检察机关公诉工作为视角

法治思维是实施法治方式的思想基础,检察机关在个案办理中就要运用法治思维来指导司法实践。目前,检察机关在个案办理中存在着公诉执法理念亟待更新、案件审查过程中错误指控或监督缺位、缺乏具体规范的公诉案例指导制度等问题。因此,必须更新公诉执法理念,强化法律监督和自我监督,切实把握好办案数量、质量及效率、效果之间的关系,借鉴防错案方法论,加快构建公诉案例指导制度。

On How to Handle Cases from Legal Thinking Horizon---From the Perspective of Public Prosecution of Procuratorial Organs

Legal thinking is the thought foundation to implement the rule of law, and in judicial practice, the procuratorial organs should handle the cases according to the rule of law. At present, there exist some issues on the procuratorial organs handling cases, such as lack of new law enforcement concept, accused falsely, absence of supervision, and lack of guidance system of the specific standard of public prosecution case.Therefore, we must renew the idea of public prosecution law enforcement, strengthen legal supervision and self supervision, grasp the quantity and quality of handling cases, cope with the relationship between the efficiency and effectiveness, and through making reference to prevent wrong case methodology, speed up the construction of public prosecution case guidance system.
