再论国际私法上的公共秩序保留——兼评国际私法上的公共秩序与国内民法上的公共秩序之异同

国际私法上的公共秩序与国内民法上的公共秩序不完全相同,必须把国内民法上的公共秩序和国际私法上的公共秩序加以区分。相比较而言,国内民法上公共秩序要比国际私法上公共秩序的范围更加广泛。本文结合相关立法,分别从民法的角度和国际私法的角度分析公共秩序的含义,两者之间的关系,以及我国公共秩序立法中存在的问题和应做的修改和完善。

A New View on Reservation of Public Order on Private International Law

The meaning of public order on private international law is not exactly the same as that on domestic civil law. So a distinction should be made between them. Comparatively speaking, the latter is much wider than the former with regard to their scope. The author hopes that, by analyzing the meaning of pubic order in terms of private international law and domestic civil law respectively and their relationship, the author can find some of the defects in the present relevant legislation of China; further more, point out how to make some modifications and perfection accordingly.
