监狱严管效能渐趋式微与对策探寻——从行刑宽严相济视角解读

对极少数抗拒改造、行为恶劣的罪犯实施严管是保证监狱改造秩序，促使这部分罪犯改恶从善的必要惩戒措施。就狱内违法违纪的惩戒而言。它的指向并非是绝大多数积极改造的群体，而涉及到刑事处罚的再犯罪又毕竟少之又少，故严管这一措施确有其主流手段及相对严厉的惩戒效能。但是，由于严管罪犯的“不过如此”心态。以及执法管理者的力不从心，严管效能已渐趋式微。通过数据统计和理性分析，以宽严相济为视角。力求从罪犯为何不惧严管、监狱相关措施的缺位、执法体系及教改手段等层面进行原因探求，是解决问题的重要途径。

Probe into Strict Prison-management Performance's Declination and Countermeasure

To minority of criminals who resist re-education and hold bad behavior, strict management is a necessary method to ensure the prison order and make some criminals abandon their evil. As to punish the violations of law and discipline in prison, it does not direct the vast majority, and the criminals related to the crime and then, after all, are very little, so strict management has its means and relatively efficiency. However, because of criminals＇ ＂Buguoruci＂ mentality as well as the insufficient law enforcement, it has gradually declined. This paper here gives a statistical data and rational analysis, and takes a deep probe into its absence of measures related to the prison, law enforcement system and the reform means.
