论行政允诺范式的阿基米德支点--以“黄银友案”为分析对象

行政允诺虽已被最高人民法院增列为新型行政行为之一,但行政法学及法律规范中均缺少对其内涵的进一步解释。以"黄银友案"裁判文书为观察切入点,发现行政相对人从不特定转变为特定并引起法律关系端点发生变动,进而从中抽象出行政允诺二阶段论之范式。通过剖析其他涉及行政允诺的司法实例以检视这一初步范式。对比分析显示,行政允诺之相对人既包括特定相对人,也包括不特定相对人;涉及行政允诺的司法实践易与他类案由发生复合。

On Archimedes's Fulcrum of Administrative Promise---Taking Huang Yinyou Case as Example

The supreme People’s court has taken the administrative promise as one of new administrative behaviors, which still has less further connotation in the administrative law and law regulations. The article, taking Huang Yinyou Case as example, found that certain administrative counterparts have changed the legal relationship, and concludes a new mode of administrative promise. Analysis shows that the administrative counterparts include both specified counterparts and unspecified counterparts, and the judicial practice concerned the administrative promise tends to reach the composite with other similar cases.
