| 摘 要： | 版权法的效率和公平价值冲突体现了作者私权与公众利益之间的对峙.版权法通过合理使用制度来维持版权体系中利益格局的动态平衡.数字技术的发展冲击了版权法的利益平衡体系,进而质疑版权合理使用制度存在的价值.从经济学和版权法自我发展两个角度分析,网络时代版权合理使用制度仍然有其存在的必要性.我国版权合理使用制度应该应网络时代的需要进行必要的调整.

| Abstract: | Ever since its establishment, the copyright law has encountered the antinomy of author's rights and public benefits. Therefore copyright fare use system is designed and periodically revised to equilibrate the antinomy. In Internet ages, a series of profound changes are brought to the balance of benefits in copyright law as well as to the copyright fare use system by digital technology. In fact, copyright fare use system is necessary in Internet ages on the basis of economics and copyright law's development. This essay gives some advice on the reestablishment of copyright fare use system in Internet ages in China. |
