试论法治思维和法治方式视野下检察工作改革的规范化

在当前党和国家对国家和社会实行法治思维和法治方式治理的视野下,加强检察改革的规范化不仅是检察工作科学发展的正当性要求,而且非常具有必要性和重大意义。为保证检察改革正确的价值导向和规范化推进,加强和实行检察改革的规范化必须坚持依法创新、由上级领导机关掌控和有序推进、建立创新价值评估体系、实行上级院主导授权和下级院申请实施相结合、鼓励机制创新等原则。构建检察工作改革规范化制度应作以下设计:省级以上的人民检察院应设立主管部门,实行省级以上检察机关的机制创新授权制,机制创新的申报制和立项核准制,应建立主管部门的跟踪监督制、中期考察评估制和试行期满的考核验收制,应建立工作措施创新的推广制,应建立工作措施创新项目选题的奖励制。

The Standardization of Procuratorial Reform in Relation to the Ideology of the Rule of Law

With the current background of governance by “the Rule of Law” adopted by the Communist Party and the State government, it is legitimate and necessary to strengthen the standardization of the procuratorial reform. In order to ensure the correct value guidance and promote the standardization of procuratorial reform, we must adhere to a few principles: law -abiding innovation, supervision by the higher authorities, orderly progression, the establishment of innovation value evaluation system, the combination of authorial guidance with applications by subordinate procuratorates, and incentives to innovation. The construction of procuratorial work reform and standardization should make the following design: administrative departments should be set up for procuratorates at or above the provincial level, authorization system for mechanism innovation application and grant of procuratorates at or above the provincial level, authorial departments and mid-term evaluation system and acceptance system for investigation and supervision, and a reward system for innovation measures and projects.
