| 摘 要： | 污点证人规则是通过对被追诉者诉讼地位的转化,实现对犯罪的有效打击。污点证人是司法实践中证人的特例,污点证人规则的核心是确立其作证豁免权。对污点证人作证豁免权的基本概念及意义进行探讨,进而确立我国的污点证人规则,有助于完善我国的刑事证人制度。

| Abstract: | The rule of tainted witness is to realize an effective attack through the change of the defendant＇s legal status.The tainted witness is an exception in judicial practice,whose core is to establish the witness immunity.Based on the basic concept and the testimony of immunity,it has great significance of China to establish the system of the tainted witness,and perfect the criminal procedure law. |
