| 摘 要： | 随着我国1998年加入联合国的《公民权利和政治权利国际公约》,是否应该给予犯罪嫌疑人、被告人以刑事诉讼上的沉默权,各种观点聚讼一时。考察沉默权的历史发展轨迹和其运行机制,结合我国现阶段的基本国情和法制发展状况的实际,我国现阶段对犯罪嫌疑人赋予沉默权还为时尚早,应予缓行。

| Abstract: | With China joining The International Covenant on Civil and Political Rights of the United Nations in 1998,there appear various views on whether the right of silence should be given to the criminal suspects and defendants in criminal lawsuit.After the investigation of the historical development of silence and its mechanism,according to the current situation and development of the basic law,it is too early to apply the right of silence in our country. |
