消费者权益保护的理论与实践探析

摘    要:1993年10月31日通过的《中华人民共和国消费者权益保护法》,对保护消费者合法权益,促进社会主义市场经济健康发展具有重要意义,但仍存在一定缺陷。本文拟从该法的调整对象和适用范围、欺诈行为与惩罚性赔偿、归责原则、争议解决途径等方面,就国家对消费者权益的保护及其实践略抒己见。

Abstract:The Law of Protecting the Customes' Right adopted on 31th.10.1993 has played a great role in protecting the customers' right and promoting the healthy development of socialism market economics, but there still exists some shortages. The article, from its mediation scope, applied range, fraudulent act, punishment as compensation, doctrine of liability fixation and the solution of issue, brings out its own opinion to the protection and practice of the customers' right.
