| 摘 要： | 我国刑法规定累犯构成的时间限制为刑罚执行完毕或赦免以后5年.笔者认为该规定将刑罚执行期间再犯新罪的排斥在累犯之外是不合理的,建议将在刑罚执行期间再犯新罪的纳入累犯的范畴.

| Abstract: | In our country, penol code fixes the time limit of commulative offense, that is five years after the end of execution of punishment or grace. The author thinks it unreasonable not to take the crime in the duration of execution of punishment as commulative offense, and suggests that it should belong to commulative offense. |
