| 摘 要： | 我国刑法第193条规定的贷款诈骗罪在司法实践中存在诸多弊端,建议完善贷款诈骗罪的主观方面和主体条件,改变以合同诈骗罪追究单位及其主管人员和直接负责人员贷款诈骗行为刑事责任的做法;将单位纳入贷款诈骗罪的犯罪主体;增设贷款欺诈罪。

| Abstract: | In our country's No.193 article of Criminal Law,the stipulation of the crime of swindling loan has many disadvantages in judicial practice.The article here takes a probe into it,and suggests that we should perfect its subjective condition,change the original way of pursuing the liability of unit and the executives,regard the unit as the body of crime,and set the crime of swindling loan. |
