检察建议制度的发展路径探析——以提升“检察建议刚性”为核心点

2018年修改的《人民检察院组织法》将检察建议明确规定为检察机关履行法律监督职责的方式,同时规定了相关单位应予配合,及时将采纳情况书面回复检察院,一定程度上有助于检察建议“刚性”之提升。此外,《人民检察院检察建议工作规定》对线索发现、调查核实、制发、监督落实的每一办案环节进行具体规定。实践中,检察建议仍会面临质量参差不齐、刚性不足、相关单位不配合难落实等窘境。检察建议制度的改革,应当把握事中监督、参与式监督、动态监督的大方向;办案方式上探索“案件化”工作模式,方能做到每一办案环节的规范高质,助推检察建议的刚性效力实现,切实发挥法律监督之重要功能。

Analysis of the development path of the procuratorial suggestion system——Focus on improving the rigidity of procuratorial suggestion

The“Organization Law of the People’s Procuratorate”revised in 2018 clearly stipulates procuratorial suggestion as the way for procuratorial organs to perform legal supervision duties,and also stipulates that relevant units should cooperate and promptly reply to the procuratorate on the adoption status in written form,which is helpful to the improvement of the“rigidity”of procuratorial suggestion to a certain extent.In addition,the“Regulations on Prosecutorial Suggestion Work in People’s Procuratorate”provide specific provisions for each case-handling link of clue discovery,investigation and verification,preparation and distribution,and supervision and implementation.However,in practice,procuratorial suggestions still face the dilemma of uneven quality,insufficient rigidity and difficulty in implementing without cooperation of relevant units.The reform of the procuratorial suggestion system should follow the general direction of in-process supervision,participatory supervision and dynamic supervision,and explore the“case-based”work model in case handling,so that the standard and high quality of each case handling process can be achieved,the rigid effect of the procuratorial suggestions can be promoted,and the important function of legal supervision can be earnestly exerted.
