| 摘 要： | 刑事抗诉难的原因有两点：一是法律规定的抗诉条件不具体,没有可操作性,二是抗诉的机制不适用。解决抗诉难的办法最好是设置上诉审法院,由上诉审法院审理上诉和抗诉案件。

| Abstract: | There are two reasons for difficult to resist criminal appeals:First, the condition of appeal made by law is not specific,there is no maneuverability, and the other is the appeal mechanism does not apply.The best way to resolve the resist difficulty is to set up an appeal examine court,and the appeal and resist cases are examined by the appeal examine court. |
