| 摘 要： | 民法典作为社会生活的重要规范,社会自身的进步力推动了民法的发展和现代化,日本法律在亚洲的地位和影响不言而喻,而韩国与日本之间,历史上有着极为密切的联系,分享着几乎相同的文化传统。因此,日本作为比较的参照物,对韩国的民商法的现代化发展有着重要的意义。

| Abstract: | The Civil Code is the important criterion of social life.The social progress itself promoted the development and modernization of the Civil Code.The position and the impact of the laws of Japan in Asia are self-evident.There is extremely close relation between South Korea and Japan in history.They share almost the same cultural traditions. Therefore,it is of important significance to take Japan as a comparative reference for the modernization of the Civil and Commercial Law of South Korea. |
