| 摘 要： | 从治理理论分析国家与社会之间的新型关系,得出警察权是国家公权力与民众博弈的结果,在此基础上探讨警察权与警察职能的关系,强调新形势下警察职能的转变,从而推导出警察权的“四化”走向。将治理理论运用于法学领域, 在国内外尚属创新,不仅是法学理论上的进步,也极具学术价值和现实意义。

| Abstract: | Discussing the new relationship between country and society under the governance theory, we make a result that the police power is a part of the national authority. And in this foundation, we analyze the relations between police power and police function, emphasizing the police function transformation under the new situation, thus infer the police power'sFour Modernizations" trend. Utilizing the legal domain by the governance theory and analyzing the police power is the first one in domestic, not only will be a theoretically innovation in legal science, but also has extremely academic value and practical significance. |
