对抵押登记制度若干法律问题的探析

抵押被称为"担保之王",是最具典型的担保方式,抵押登记制度在整个抵押法律体系中具有重要的地位。司法实践中,在抵押登记制度上仍存在一些争议较多的问题,笔者力图通过对不动产、动产的抵押登记效力及登记程序中存在的缺陷等问题进行分析和探讨,为我国担保立法的完善提出积极的建议和思考,为更好促进担保法律制度的发展做出有益的探索。

Analysis of a number of legal issues on mortgage registration system

The mortgage is called "the king of guarantee",which is the most typical way of security,so that the mortgage registration system has an important place in the entire legal system of mortgage.In the judicial practice,there is still some controversy in the mortgage registration system,the author tried to analyze and discuss through the defects in the mortgage registration effect and process of immovable property and movable property to give positive suggestions and thinking for the perfection of the security legislation in China,to make a useful exploration to better promote the development of the legal system of guarantee.
