新刑诉法中亲属证人特免权研究

亲属证人特免权在我国是一个古老的制度,也是一个新鲜的制度,历史上在儒家思想的影响下就曾有"亲亲相隐"的规定,可一直以来我国的刑事诉讼法中却没有相关的规定。这次新刑诉法在要求证人出庭作证的前提下规定了法院不得强制被告人的近亲属出庭作证,这也是我国近代以来第一次规定了亲属证人特免权。新刑诉法规定特免权的本意是维护伦理道德及家庭社会的稳定,但由于其对亲属证人特免权这一制度规定的不完善性导致在司法实践中可能出现一些消极的后果。本文以新刑诉法中"亲属证人特免权制度"的相关条款为对象,试图探究其实质及缺陷。

Study of the right to dispensation of relative wimesses in the new Criminal Procedure Law

The right to dispensation of the relative witness in China is an old system,but also a fresh system.In the history,for the Confucian influence,there was once the "Concealment",but there were not the relevant requirements in China’s Criminal Procedure Law.The new Criminal Procedure Law requires the witnesses to testify in court,but the court cannot compel the close relatives of the defendant to testify in court,which is for the first time that China provides for dispensation of the relatives witness in modern times.The intention of the provision of the new Criminal Procedure Law is to maintain the ethics and the stability of the family and the society,but for the imperfection of this system,there may be some negative consequences in judicial practice.This paper tried to explore the reality and defects of the right to dispensation of relative witnesses in the new Criminal Procedure Law.
