| 摘 要： | “劳动教养”作为我国一项重要的法律制度,在近半个世纪的打击违法犯罪、挽救不良青少年、稳定社会治安秩序活动中都发挥了重要的历史作用。然而,任何一项制度都是为现实社会服务的,面对改革开放后的中国, 特别是市场经济条件下的动态社会,2002 年6月,公安部与时俱进地出台实施了《公安机关办理劳动教养案件规定》。本文对劳动教养的性质、适用范围、适用程序及对公民合法权益特别是对青少年的保护性规定分别作了论述。
