| 摘 要： | 最高额保证合同常见于银行贷款关系中，由于最高额保证合同不同于普通保证合同，该类合同在保证期问、债务额的确定及当事人权利义务上均有很大的特殊性，要正确处理该类贷款担保的法律事务，必须对最高额保证合同的相关法律概念加以正确的理解，明确其与普通保证合同的差别。
